Can My Spouse Work While Her Work Permit Application Is Being Processed? Your spouse can work only if she have a work permit. If you’re sponsoring your spouse, they can apply for an open work permit. This open work permit application will take about 4-5 months to be processed.

Remember that while your spouse or partner’s permanent residence application is being processed, they must:

  • Maintain legal status as a visitor, student or worker in Canada, and
  • Wait for their work permit application to be approved before starting to work.

Your spouse or partner should use the application package to apply for an open work permit: Application to Change Conditions or Extend Your Stay in Canada as a Worker and must follow the instructions that matches their situation.

If the sponsorship application hasn’t been submitted yet:

  • Put the sponsorship, permanent residence and open work permit applications into one envelope.
  • Make sure to include:
    • all supporting documents for all applications, and
    • proof of payment, for all applications.
  • Send the envelope to the Case Processing Centre in Mississauga (CPC-M), Ontario.

If the permanent residence application has not yet received approval in principle:

  • Mail the completed application
  • Make sure to include:
    • All supporting documents, and
    • Proof of payment.

If the permanent residence application has been approved in principle:

  • Your spouse or partner can apply online or on paper for an open work permit.
  • If they apply on paper, they should mail the completed application.
  • Make sure to include:
    • All supporting documents, and
    • Proof of payment
