The moment the principal applicant obtained registration as an E2 Treaty Investor, they can obtain E2 visas for employees who are of same nationality as the investor.
Getting the E2 registration often takes 4 to 6 weeks, and obtaining E2 employee visas usually takes about two weeks. Two types of employee that qualify for E2 Visa:
E2 Executives, Managers and Supervisors
Executives and Managers are expected to be in a senior position to either manage key part or the entire business. In bigger businesses, the owners of the business may not really in practice spend much time in the USA. Such personnel must demonstrate their executive or managerial qualities, however, there is no requirement for them to have worked for the principal investor for at least one year in previous three years, like the L-1 visa. Documents necessary for the application should include the job description, resume, and supporting letter from the employer.
E2 Specialist or Essential Skilled Workers
A good way of employing highly skilled level people into the US should demonstrate that:
- The employee has expert knowledge of the business which may be difficult to obtain in the US.
- The employee is mandatory for the running of the principal investor or trader’s business in the USA.
Family and dependents of E2 visa holders
Spouses and dependents of E2 employee visas are also eligible to apply for E2 visas, and will normally be offered the same period of stay as the principal E2 visa holder. E2 spouses and dependents don’t need to be of same nationality as the principal applicant.
Spouses are allowed to work. Although, it is perhaps advisable to apply for work authorisation. Children below the age of 21 can study but unfortunately not permitted to work under the E2 Treaty Investor visa category.
Note that, a ‘visa issuance fee’ is always added to the usual visa application fee for E visas. This usually amounts to $160.
